“民事政策”之再识与重构

Reinterpretation and Reconstruction of "Civil Policies"

一般来说,学界将影响市民社会运作的政策称为"民事政策"。长期以来,人们对民事政策存在着误解,导致民事政策在我国的社会主义法治建设中被异化。因此,对被误解之民事政策从概念、功能等多方面进行再识,回溯民事政策在我国市民社会运作发展中的独特价值,并重构民事政策对调整市民社会运作的积极效能,不但能推进民事政策的科学发展,而且有助于把握民事政策运用的边界,使之与民事法律互为补充,共同促进市民社会有序健康的运行。

Scholars concerned usually call the policies influencing the civil society as ＂civil policies＂ but there have been misunderstandings of such policies, which has led to their alienation in the legal construction in China.
