摘要
我国公众参与的新形式——PM2.5自测活动的兴起,是由于规制者无法满足民众对风险信息的需求而引发的。公民参与到风险信息供应中,面临着能力性缺失和公益性缺失的障碍,但这些障碍并不能否定这种活动的正当性。公众具有生产科学信息的能力,且具有获取信息的权利基础,参与到风险信息供应领域将增加规制行为的合法性。这种民间力量不应当被忽视或压制,而应当加以利用。借鉴新行政法理念,规制者可以通过公私合作供应风险信息,来解决目前存在的信息供需矛盾,满足公民的知情权,同时符合行政合法性要求。
The new form of public participation——PM2.5 self-testing movement——arose because regulators cannot satisfy the public demand for risk information.Citizens engaging in the risk information production,faced with obstacles such as lack of knowledge and lack of public character.But these obstacles could not deny the legitimacy of this movement.The public have the ability of producting scientific information and the right to obtain information as movement foundation.To participate in the field of risk information supply will increase the legitimacy of regulation behavior.The folk strength should be used rather than be ignored or suppressed.Based on the concept of new administrative law,regulation can supply risk information through public-private cooperation,solve the conflict between information supply and information demand,satisfy the citizen's right to know,and gain administrative legitimacy.
