摘要
国家专利制度对技术发明创新起着明显的激励作用和保护作用,企业通过专利对自身先进技术的保护,确保企业的经济利益和可持续发展。然而,申请一项专利需要投入大量人力、财力和物力。所以,专利申请不是越多越好、越早越好。从是否申请专利、申请的时机、种类及内容、申请的地域范围和专利保护年限等五个方面的综合考虑入手,探讨企业如何根据自身所处行业的特点、发展水平、技术成熟度,综合考虑各方面因素,平衡各种利弊关系,作出一个最优选择,得到最佳效益。
National patent system plays the obvious inspiring and protecting function in technology invention and innovation. Enter- prises protect their own advanced technology by patent to guarantee their economical benefits and to realize sustainable development. However, applying for a patent requires a large amount of human, financial and material resources. Therefore, to some extent, the more we apply for doesn't equal the better, and the earlier we apply for doesn't wholly mean the better. From five aspects, referring to options, the right time, varieties and contents, regional range and protecting time period of patent application, this article sets about discussing how enterprises can first take some factors into consideration, including their own features, developing status, and skill proficiency, to balance advantages and disadvantages so that enterprises can make a best choice and gain the most profitable results.
