On Claimant of Administrative Compensation After Death of Victim

行政赔偿请求权作为请求权的一种,是由基础性权利派生而出的。行政赔偿请求权人的范围至少受到如下两个因素的影响:一是行政赔偿对象的广度限制;二是行政赔偿标准及方式的限制。《国家赔偿法》第6条第2款关于受害人死亡情况下的行政赔偿请求权人的规定不尽合理。在受害人死亡的情况下,应由其近亲属享有行政赔偿请求权。受害人近亲属的行政赔偿请求权并非均由"继承"得来,但在确定近亲属的请求权顺序时应当参照法定继承的相关规则。

Claim for administrative compensation, as a form of claim, is derived from the fundamental right. The scope of claimant of administrative compensation is influenced by at least factors： first the range of subjects of administrative compensation; second, the limitations of standard and methods of administrative compensation. Clause 2, Article 6 of State Compensation Law is not reasonable enough in prescribing the situation for claimant of administrative compensation after the death of victim. Under such circumstances, the victim＇s close relatives shall be entitled to claiming administrative compen- sation. Such claims are not always ＂inherited＂, yet the relevant rules about statutory succession shall be applied in deter- mining the order of claiming of close relatives.
