摘要
对《生育保险办法(征求意见稿)》进行性别影响评估,发现其引导用人单位积极参加生育保险,消除户籍歧视有助于流动妇女就业。但忽视了男性和灵活就业女性的生育保险需求,生育津贴标准忽视了女性群体中的个体差异,基金构成中的国家义务缺位。建议立法机关创设反就业性别歧视的法律评估机制,以防出现此类性别意识缺失导致的主观动机与客观效果相悖的制度性就业性别歧视。
In this paper, through gender impact assessment on The Measures on The Maternity Insurance (Draft for Comments), the author found that The Measures on The Maternity Insurance (Draft for Comments) has had a positive impact on motivating employers to actively participate in maternity insurance, eliminating household registration discrimination and contributing to the employment of migrant women. However, this draft ignores the maternity insurance needs of employees who have flexible employment. In addition, the maternity allowances ignore individual differences in the groups of women and the national obligation absences in the fund. The author recommends that the legislature create a legal assessment mechanism on anti-sex discrimination in employment to prevent gender discrimination pertaining to a social system that contrasts subjective motives to the objective effect as a result of a lack of gender awareness.
