条约法上的善意原则被引量：33

摘要善意的基本含义包括诚实、公正和合理。善意原则是一项既构成一般法律原则也构成国际法一般原则的国际条约法的基本原则。它在条约的缔结、履行、解释和争端解决的过程中通过与其他原则规则相结合的方式发挥重要作用。它维持条约法乃至整个国际法的精神和价值,保护条约主体的善意行为,排除恶意行为的合法性或有效性。
