Typical Case Teaching of Justifiable Defence

正当防卫既是刑法中排除犯罪性的一种主要事由,又是法律赋予公民的一项重要权利。刑法在强化公民防卫权利的同时,也为防止其滥用规定了较为严格的行使条件。本文拟结合典型案例,对正当防卫的教学方法,特别是案例教学法进行探讨,以期让正当防卫制度在刑法的教学中取得更好的效果。

Justifiable defence is a kind of main reason exempted from crimes in criminal law , as well as an impor-tant legal right to citizens. Criminal law not only strengthens civil defense right, but also prevents its misuse by strict ap-plication conditions. This paper discusses the teaching method of justifiable defense especially case method combined with typical cases, in order to let the justifiable defence system in criminal law teaching achieve good effect.
