谦抑即谦和、克制、抑遏、节制,行政强制程序的谦抑作为一种理念,指导我国行政强制程序的运行。程序是法治与恣意而治的分水岭,程序强调限制恣意和防止权力滥用,是防止立法者或者行政机关觊觎专擅侵害民权的坚实堡垒。现代程序与法治、民主、人权、自由、正义等价值结合在一起,在一定意义上使得程序成为实现有保障的人权、有节度的自由、有组织的民主、有制约的权威、有进取的保守的社会状态的重要基石。

Modesty means amiable, restraint, suppression and control. The modesty of administrative compulsory procedure ,as a concept, guide the operation of administrative compulsory procedure in China. Procedure is the watershed between the rule of law and rule of man. Procedure emphasizes limiting power abuse, preventing administrative authorities to infringe civil rights. The closeknit community of modern process, rule of law, democracy, human rights, freedom, justice, makes the process to be the guarantee for the realization of implementation, nodal degrees of freedom, guaranteed human rights organization democracy, restriction of authority, progressive conservative social status.
