在审理案件的过程中,法官要作出裁判,就要查明案件事实,使法官可以`体验'过去发生的案件事实.因此,证据的审查判断是主观的判断,判断的标准和判断方法都是主观的.回避法官判断证据的主观性,只能是掩盖了裁判的实质.但是同时,证据的判断过程却是主观认识和客观事实的统一,为了作出公正的裁判,立法和司法有必要把主观判断的客观化作为自己的追求.

In the course of trying a case judges need ascertaining the facts which greatly calls for subjective judgements both in judging norms and methods． The paper aims at expounding the unity of subjective cognition and objective facts which is just a vital thing that any impartial judges should have both in legislation and judicature．
