关于我国商品房预售登记制度之探析

摘要 房地产开发企业为了保护商品房预售过程中预购人的合法权益,促进房地产市场依法有序健康发展,在商品房预售过程中应不断加强政府监管行为,完善商品房信息公开制度,引入开发商信用评级管理系统,通过增强信息透明度来加强社会监督。同时,通过法律强制规定预售登记备案行为的预告性,赋予预售商品房准物权效力,使预购人的物权保护有了法律依据。只有从行政管理及法律角度不断完善商品房预售登记备案制度,才能够更好地保护消费者合法权益和维护正常的房地产开发秩序,最终促进整个国民经济快速、健康、有序发展。 In order to protect the purchasers' legitimate rights and interests in the process of commercial housing pre-sale and promote the development of the estate market legally, orderly and healthily, we should strengthen government regulation behavior in the pre-sale Of commercial housing, improve the information disclosure system, and introduce the credit rating management system of the developers and strengthen social supervision by enhancing the transparency of information. At the same time, through the law we should mandatorily stipulate the pre-sale registration act, give the quasi property rights of pre-sale commercial housing, which will give the purchasers a legal basis for rights protection of property. From the perspective of the administration and law, only improving the system of commercial housing pre-sale registration constantly can it protect consumers' legitimate rights and interests and safeguard the normal order of the estate development better. Ultimately it can promote the national economy develop rapidly, healthily and orderly.
