摘要
国家标准的版权特征不同于《著作权法》所保护的版权特征,国家标准虽有文本,但通常缺乏明确的著作权主体,对国家标准的版权认定应该首先明确其作者主体。《著作权法》保护的版权是私权、私利,而国家标准在更大程度上体现的是公权、公利。国家标准的出版权主要来自出版资格和作者授权两个方面,因而国家标准不存在所谓的"专有出版权"。
Copyright of national standards is different from the right protected by Copyright Law.There are texts on national standards but without definite copyright subjects.The identification of their copyrights must begin from the specification of the subjects.Copyright Law protects personal rights and interests whereas national standards reflect more on public rights and interests.The publishing rights of national standards are originated from publishing qualification and empowerment of authors,so they have no ＂exclusive publishing rights＂.
