完善我国国防专利法律制度的研究

Further Research on National Defense Patent Legal System

我国专利法律制度实施近30年,取得了非凡的成就。国防专利制度作为国家专利法律制度的重要组成部分,在激励创新、保护国防科技成果、提升国防综合竞争能力及维护国家安全方面发挥了积极的作用。实践表明,我国国防专利制度设计尚存一定的缺陷,实施中还存在一些亟待解决的问题,导致国防技术产权功能没有充分发挥,运行效率不高。在制度及实证研究的基础上,提出完善我国国防专利制度的对策和建议。

China＇s patent law system has made remarkable achievements since its implementation nearly 30 years ago. As an important part of the patent law system, the national defense patent system has played an active role in the innovation, protecting national defense research achievements, raising comprehensive competitive power and safeguarding state security defense .The practice shows that the design of national defense patent system is not so pecfect that it causes low efficency in utilizing defense technical property. Thus the authour proposes some countermeasures to perfect national defense patent system basing on in stitutional and empirical research.
