Thinking about Improving the Cultural Legislation System

我国现有文化事业立法重"管理"轻"服务"、重"义务"轻"权利"的特点,严重阻碍了中央提出的建设"覆盖全社会的公共文化服务体系"的公共文化发展目标的实现。建设和完善我国文化事业立法体系,要确立尊重和保障公民文化权利的新思路,其立法价值取向应当从管理型向服务型转变,明确国家在提供公共文化服务中的职责和义务,充分尊重和保障公民的文化权利,不断加大公共文化产品的财政投入。同时,建设和完善文化事业立法体系,要与深化文化体制改革以及文化产业的发展结合起来,适应实施国家文化强国战略,发展公共文化服务的新需要。

At present in China, when we legislate on the cultural undertakings, we always attach importance to management and obligation, while despise service and rights, which seriously Impeded the realization of the goal＂constructing the public cultural service system covering the whole society＂ by central ministries.If we want to improve the legislation system of the cultural undertakings, we should have new ideas,which is respecting and protecting of the cultural rights for the citizens.We should change the value orientation of legislation from management to service.We should strengthen the responsibility and the state in providing public cultural service for the government . We should endorse the national respect for and protection to the cultural rights of citizens, and provide financial investment in public cultural products.If we want to improve the cultural institutions structure system of legislation, we should take it and to deepen the reform of the cultural system, the development of cultural industry with the implementation of the national culture, to adapt to the becoming a cultural power strategy, to meet the need of the development of public cultural services.
