Rule of Law toward Order and Justice and Its Specific Path

自改革开放以来,中国共产党为找寻一种具有内在生命力的法治模式作了诸多努力并取得了巨大的成就。当前,社会主义法治国家建设正处于社会转型阶段的瓶颈时期,一种通往秩序正义的法治形态尚未真正或完全确立。党的十八大报告中关于法治的部分回应了我国社会转型阶段的现存问题。当前应以民生法治为基本导向,以民生立法、服务型政府和能动司法为基本面向,推进我国的社会主义民主法治建设。

Since the reform and opening-up in 1978, the Communist Party of China (CPC) has been seeking for a rule of law with internal vitality, and great achievements have been made. At present, the building of a socialist country under the rule of law is on a bottleneck period of social transformation. A rule-of-law status toward order and justice has not been virtually or completely established. The content regarding rule of law in the report delivered on the 18th CPC National Congress responds to the existing problems during China’s social transformation. At present, with improving people’s livelihood and rule of law as the basic guide, efforts should be made to promote the socialist democracy and rules of law by focusing on legislation on improving people’s livelihood, building service-oriented government and judicial activism.
