澳门葡据时期刑事司法与犯罪控制体系研究

Research into the Criminal Justice and Crime Control System in Macao’s Portuguese Period

1553年葡萄牙人始定居于香山澳（澳门），此期间，欧式的司法制度引入澳门。除因“移民”所带来的法律移植以外．还保留了传统中国的刑事对策，尤其是明清两朝“华夷分治”——化外人归罪原则的适用．形成了“澳门特色”的二元制刑事司法体制。由于葡萄牙殖民者“始领澳”（1553年）时正值欧洲中世纪晚期。所以，澳门葡据时期的刑事司法也承继了欧陆中世纪法律，这是殖民地刑事司法体制中一个独有的现象。至于法治化时期．葡据下的澳门逐渐建立了警察侦查体制，并设置相应的“侦查责任区”，澳门葡据时期的刑事司法与犯罪控制体系逐渐建立起来了。

Portuguese＇s settling down in Macao began in 1553 and then the European judicial system was first introduced into Macao. Except for the law transplantation caused by the migration, Macao also retained the traditional criminal countermeasures of China, especially those employed in Ming and Qing dynasties, thus a dual criminal justice system with Macao characteristics was formed . Since the migration of Portuguese took placed in European late middle age, Macao＇s criminal justice inherited some contents from European medieval laws, and this presented as a unique phenomenon. In the period of lawrization, Macao gradually established the system of the police investigation, and set up the corresponding ＂investigation duty area＂, and gradually the criminal justice and crime control system has been established.
