摘要
由于受教育权的破坏、受监护权的转移、发展权的限制,已出现农村留守儿童学业成就感不强,失学现象严重;心理问题突出,性格形成出现偏差和情感交流欠缺;道德品行产生偏离等不良后果。法律保障是解决农村留守儿童受教育权问题的重要路径,具体解决途径包括:对进城农村留守儿童给予法律救济;制订父母返乡就业的相关法律和保障制度;完善学校教育补偿制度来补偿家庭教育权的缺失,以实现农村留守儿童的健康发展。
Left-at-home rural children (rural children left at home by their parents seeking employment in cities), due to the lack of their right to family education, the transfer of guardianship, and restrictions on the right to development, generally demonstrate a weak sense of academic achievement, high school dropouts, serious psychological problems, devious personality, insufficient emotional communication, and devious moral character. Legal remedy is an important approach to realizing their right to family education. Specifically, to help them grow up healthily, it is necessary to give them legal remedies when they study and live in cities, formulate relevant laws on their parents' returning home for employment and the security system, and improve the system for educational compensation.
