体育伦理视野下的我国《体育法》修订

China's Sports Law Modification from Sports Ethics Perspective

体育法不仅服从于体育伦理的价值取向,而且,与体育伦理具有互补性。体育伦理催生体育立法,并改变着体育立法的目的。从体育法的体育伦理法则来看,人本是体育法逻辑起点的体育伦理法则;人道是体育法价值导向的体育伦理法则;人文是体育法运行条件的体育伦理法则。在新的历史条件下,我国《体育法》必须坚持"以人为本"的伦理价值,重构《体育法》的立法宗旨,增加"以人为本"的目的条款,同时,确立"以人为本"原则、体育自由与公平原则和绿色体育原则,确认公民体育权利,构建权利救济制度;健全体育社团内部处罚程序规则,建立个人信用制度;合理配置民事责任、行政责任和刑事责任,完善法律责任体系和确立环保义务等。

Sports law is not only obey the sports ethics evaluation and value orientation,but also is complementary with sports ethics.The sports ethics is spawned sports legislation and is continuing to change the purpose of the sports legislation.From sports ethics rules of the sports law,humanism is sports ethics rules of the logical starting point of the sports law,humanitarian is sports ethics rules of the value oriented of the sports law,and humanities is sports ethics rules of the operating conditions of the sports law.Under the new historical conditions,china＇s sports law should adhere to the concept of sports scientific development.Therefore,legislative purpose of the sports law should be reconstructed to increase the purpose of the terms of the ＂ people-oriented,＂ establish the principle of the people-oriented,sports free and fair and green sports,set up citizen sports rights and its relief system,sound societies internal punishment program rules,establish personal credit system and environmental protection obligations and improve the liability provisions to modify the sports law.
