摘要
追求工资增长的正义秩序,维护劳动关系和谐稳定是劳动法孜孜以求的重要目标。对价理论构建的工资自由秩序因认识论的缺陷而丧失其内在道德性。在马克思主义立场上反思,工资体现的是以一定比例划分社会主体对劳动所创造的社会总财富的分配关系。工资秩序正义与否最终取决于社会基本结构与社会财富分配方式的道德性。关系正义理论有力反驳了传统正义理论的偏见,为重新构想工资增长的正义秩序提供了道德评价的根本依据——"公平对待劳动者",它派生出两个基本原则:对等决定劳动条件原则与保护劳动者人权原则,据此构建工资增长的正义秩序不仅是理论上可行的思维步骤,也是制度构建的可能方向。
Maintaining harmonious and stable labor relations and constructing the justice order of wage growth is the important goal of labor law.By the limition of the theory of knowledge,the constrcution of wages growth order based on theory of contract failed to reach the end of justice.Trough reflection from Marxist standpoint,the hart of wages is how to distribute social treasure equally.In accordance with basic principles of equity and social justice,constructing the justice order of wage growth is not only a pressing need but a practical possibility.
