中国特色社会主义法律体系的完善与发展需要长期坚持。以人为本、上下有序、内外协调、动态均衡、公正与效率辩证统一、统筹兼顾与可持续发展是完善中国特色社会主义法律体系的基本原则。以人为本原则是中国社会主义民主建设和法律发展的重大理论创新、制度创新。上下有序原则是处理法律体系内部关系的基本原则。其确保法律体系的整体与部分、中央立法与地方立法、上位阶的法与下位阶的法上下一致、相互统一。内外协调原则是关乎法律体系内部诸因素之间及其与外部环境因素之间是否相互协调、功能一致的原则,是保证法治运作系统权威高效的关键。均衡原则是一切法律活动、特别是法律体系构建的最终协调机制和最高秩序依归。完整的法律系统是由静态的、表现为规范形式的法律体系和动态的、表现为法制产生、运行、实现过程的法律调整机制组合而成的一个大的系统结构。公正和效率的矛盾是社会历史领域所有价值目标体系的基本矛盾。公正与效率辩证统一原则不仅体现在政治原则、法律规定、道德要求、宗教训诫以及经济活动中,而且体现和渗透在彼此之间的矛盾冲突与联系互动之中。统筹兼顾原则主要是指法律体系在结构—功能意义上的上下有序原则和内外协调原则,但在动态演进意义上看,则应坚持可持续发展原则。

Improvement and development of socialist legal system with Chinese characteristics needs long -term adherence. People -oriented, ordered up and down, internal and external coordination, dynamic pro- portionality, dialectical unity of fairness and efficiency, overall consideration and sustainable development are the basic principles of improving socialist legal system with Chinese characteristics. People - oriented principle is the great theoretical and institutional innovation in Chinag socialist democracy -building and legal develop- ment. The principle of ordered up and down is required by the internal relationship of the whole legal system. The principle of internal and external coordination is related to the coordination and consistency with the func- tion between the internal factors of legal system and the external environmental factors. It is the key to ensure the authority and efficiency of legal operation system. The principle of proportionality is the ultimate coordina- tion mechanism and the highest order prevailing all legal activities, in particular the legal system construction. Complete legal system is a combination of a large system structure composed of the static, expressed as a ca- nonical form of the legal system and the dynamic, expressed as a generation, operation and realization process of legal adjustment mechanism. The contradiction between fairness and efficiency has been the basic contradic- tion of all ＂~alue target systems in the field of social history. The principle of dialectical unity of fairness and ef- ficiency is not only reflected in the political principles, legal prescription, ethic requirements, religious ser- mons, and economic activities, but also reflected and permeated in their conflicts and engagements. The prin- ciple of overall consideration mainly refers to the principle of ordered up and down and the principle of internal and external coordination in the structural - functional significance of law system, but in the sense of dynamic evolution, it should adhere to the principle of sustainable development.
