论第三方电子支付中付款人的抗辩问题

Problems Concerning Counterargument of Third-Party E-Payment Payors

目前,由于立法缺失,我国第三方电子支付付款人的抗辩权往往受制于支付服务合同的安排,实行普遍的抗辩切断,对付款人显不公平,有必要进行专门的立法调整。我国应加快相关立法,对第三方电子支付付款人的抗辩问题进行专门规定。通过法律法规禁止付款人抗辩延伸至第三方支付机构;允许付款人在具备特殊抗辩事由的情况下才可向第三方支付机构行使抗辩,使第三方支付机构停止或撤回对收款人的支付。

As a result of legalization deficiency, the counterplea rights of third-party e-payment payers now are generally conditioned by payment service contracts with general cutting off of counterargument, which is so unfair to payors that specialized legal adjustment is required. China should expedite the legalization process in addressing the demurrer problems of the third-party e-payment payers in an effort to prohibit to extend payer counterargument to the third-party payment agencies and allow payers to exercise counterplea to the third-party payment agencies in the case of having special counterplea causes to make the agencies suspend or withdraw payment to receivers by laws and regulations.
