论司法介入内部体育纠纷解决的思考

司法介入内部体育纠纷的问题,首先需要探讨体育是否为区别于传统法律关系的特别法律关系。体育法是特别独立的部门法。专属于体育部门法下的内部体育纠纷无法寻求传统的司法途径予以救济。对于内部体育纠纷解决而言,从"体育自治"到"中立救济"是其历史发展规律。对司法介入内部体育纠纷解决路径,我国应该借鉴国外体育法庭的经验,设立体育审判庭;同时注意其介入的必要限度。

As for judicial intervention in sports disputes,first of all we need to explore whether sports is different from the traditional legal relationship and it is a special legal relationship.Sports law is an independent department law.Exclusively subject to the sports department law,the internal sports disputes can not seek traditional judicial remedies.The internal sports dispute resolution developed from ＂sports autonomy ＂ to ＂neutral relief ＂ historically.On the paths for judicial intervention in sports disputes,China should study from foreign sports court to set up sports tribunal;at the same time pay attention to the extent necessary to intervene.
