"中止减让或其他义务"作为WTO争端解决机制中最后的、最强有力的强制措施,在争端解决执行程序中具有重要的地位。中止WTO义务的目标关乎对贸易报复机制的评估和规则设计。由于DSU条文本身并未就这一点做出明确规定,理论界和实务界对此产生了很多争论。在对既有观点进行评析的基础上,对报复机制的目标进行理论和实践分析,认为WTO报复机制具有多元化目标。

As the last hut not the least resort of DSU, the suspension of concessions and other obligations plays an important role in the implementation of WTO decision. To define the goal of the retaliation mechanism has a great effect on the estimation and the design of the retaliation mechanism. By analyzing the present opinions on the possible goals of the mechanism, the author drew the conclusion from arbitration practices that the retaliation mechanism has multiple goals including the promotion of the compliance of WTO rules, the rebalance of counter-interests, etc.
