摘要
人格权的商品化问题早已引起了我国学术界的广泛关注,不同学术领域的专家学者从不同的权利定性出发,对人格权益中财产利益的保护问题进行了有益的探讨。我国《人格权法》的修订为契机,再次探讨此问题。首先在人格权体系中提出人格标识的概念,并进一步界定人格标识中的财产利益;然后对比分析国外发达商品经济国家相关问题的理论研究和法律规定,以及我国目前相关问题的学术研究和法律规定;最后针对提出和分析的问题,阐述某些观点和看法,以求有益。
The problem of the commercialization in the right of personality has drawn wide attention in the academic circles. Different scholars from different rights qualitative has carried on the beneficial discussion about the property interest in the personality identification. When drawing up The Personal Law, this paper discusses this problem again. The first part put forward the concept of personality identification and further define the property interest in personality identification. Then compares and analysis of the foreign countries related theory research and laws and regulations, as well as the related law in our country at present. Finally, according to the questions this paper put forward and analysis, the author's own some views and opinions.
