Soft law is a practical and controversial topic in the field of international law, the scholars still have not reached a consensus on the theory since decades have passed. Different research methods used by the scholars lead to the confusion of the concept of soft law, so it must be cautious to point out what kind of method to be used. The concept used here refers to the special non-law norms existing in the international society which have functions such as demonstration, explanation, transfer, supplementary and reconstruction. The soft law has close relationship with the state＇s soft power, the improvement of which will be beneficial for the state to join in the enactment and application of soft law, and strengthen the discourse power in the fields the norms relevant to.
