“控规调整”何去何从?——基于博弈分析的制度建设探讨

PATH FOR ADJUSTMENT OF REGULATORY PLANNING:DISCUSSION ON INSTITUTIONAL CONSTRUCTION BASED ON THE GAME THEORY

针对控制性详细规划局部调整工作的一些基本认识和方法问题进行探讨。首先分析了控规调整的产生和作用,既肯定了其存在的价值,也承认其为一把"双刃剑",极可能造成广泛的消极影响;进而借助新制度经济学及其产权理论的视角深入剖析了控规调整带来消极影响的原因,并通过利益相关者的博弈分析探寻问题的症结,提出解决问题的途径——有效的制度建设;最后针对问题的症结,结合一定的制度理论,进一步探索控规调整有效的制度化路径,指出当前所需建立的关键制度机制及其基本原则和方法,并提出制度化影响下未来控规调整工作的转型方向。

This paper discusses some basic issues of the concepts and methodology concerning the adjustment of regulatory planning. Firstly, the paper analyzes the causes and functions of the adjustment. Although the value of the adjustment is undeniable, it is actually a ＂double-edged sword＂ that may cause wide negative influence. Secondly, the paper illustrates the causes of the negative effects from the perspectives of new institutional economics and theory of property rights, and tries to address the causes of the problems through the game theory and provide solutions （effective institutional construction）. Finally, the paper points out the effective way and the key factors of institutional construction in combination with some institutional theories, the substantial institutional mechanism and its fundamental principles and methods, as well as the future transitional directions of the adjustment influenced by related institutions.
