医疗产品损害惩罚性赔偿的法经济学分析 被引量：1

摘要 《侵权责任法》第59条确定了医疗产品损害中的医疗机构和生产者之间的不真正连带责任关系,同时第47条规定的产品责任中的惩罚性赔偿规则同样适用于医疗产品损害。为了确保惩罚性赔偿制度对医疗产品损害遏制作用的实现,而又不对药品生产者的创新产生阻碍,应当将其主观适用条件限定在故意和重大过失。基于侵权人角度的成本收益分析,惩罚性赔偿金与补偿性赔偿金之和,应当不小于未采取预防措施时的收益与采取预防措施时的收益之差。
