社会管理创新视野下的社会组织法律体系建构

Establishing Legal System of Social Organizations from the Perspective of Social Governance Innovation

社会管理创新既是社会管理模式的创新,也是社会管理理念的更新,其蕴涵的基本理念是人权保障、民主参与和社会本位。我国社会组织法律体系还存在诸多问题,控制型管制理念根深蒂固,立法不能满足社会组织发展需要,立法实体内容存在严重缺陷。建构我国的社会组织法律体系,首先应当树立新立法理念,其次要进一步完善社会组织法律体系。

Social governance innovation includes a model innovation of social governance and an update of the concept of social governance.The basic idea of social governance innovation contains protection of human rights,democratic participation,and society orientate.It has exposed some problems on legal system of social organizations,such as stubborn control concepts,legislation of not meeting the development of social organization,and serious defects on legal content.To establish legal system of social organizations,new legislation concept should be adopted at first,and legal system of social organizations should be improved further secondly.
