The Normative Context and Localization Construct of Social Law

西方国家的社会法起源于对人类生存社会维护的共识和为矫正市民社会自发秩序"恶果"的社会立法之中。社会法规范语境认为"保护与补偿社会弱者,适当满足人们基本生存和发展需求,采取管制与自治相结合的手段,促进社会公平公正"的目的与价值是社会法存在论的基础,公私法二分法只不过是国家通过对法律制度的构造和控制来传递当时的社会性需求的产物。在我国社会法起源于"国家主动以制度形式满足人民‘希望生活越来越幸福美好’的基本社会性需求和社会心理动机",社会法生成是法制发展的自觉反应过程,社会法建设是社会主义国家法制建设的社会主义本质要求,我们应从部门法角度来构建具有中国特色的社会法体系。

The social law in western countries originated from the consensus of social maintenance for human survival and social legislation for rectifying the ＂bad consequences＂ of spontaneous order in the civil society.From the perspective of norm context of the social law,the purpose and value of ＂protect and compensate the weak of society,appropriately meet people＇s basic survival and development needs,adopt the combination means of control and autonomy,promote social fairness and justice＂is the existing basis of social law,the dichotomy of public law and private law is merely the product of transferring social demand by states through the formation and control of the legal system.In our country,the social law originated in＂the state takes initiative to meet the basic social needs and social psychological motives of ＇hope that life is getting better and better in the form of system＇in the form of system＂.Social law generation is the conscious reaction process of legal development,the construction of social law is an essential requirement of legal construction of the socialist countries,so we should build social law system with Chinese characteristics from the aspect of sector laws,in order to adapt to requirements of the current economic.
