On Judicial Public Sentiments:Dilemma and Solution

民意是社会公众对某些案件大体相近的、带有普遍性的意见,它在给司法带来有利作用的同时,也影响着司法的自治性、司法程序的主治性和司法裁判的既判力,使司法陷入民意困境。而这种困境主要是由于司法者与民众的思维方式、司法裁判与民意评判的形成方式以及司法裁判与民意的本质特性方面存在差异。因此,要破解这种困境,就必须以司法独立为基本前提,在法律的框架内尊重民意并不断完善相关制度,畅通民意参与渠道。

Public sentiments are the social public＇s similar and universal opinion about some cases, which both bring beneficial effect on judicial affairs and affect judicial autonomy, indications of judicial process, and res judicata of judicial judgment, thus creating judicial sentiments dilemma. However, the dilemma is mainly due to the differences in judicial and civil ways of thinking, ways of forming judicial referee and public sentiments, and the nature of judicial referee arid public sentiments. Therefore, the solution of the dilemma demands judicial independence being the basic premise, paying respect to public opinion within the framework of law, improving relevant systems constantly, and clearing channels in listening to public sentiments.
