社会矛盾纠纷大调解工作机制建设研究——以云南省楚雄市大调解机制为例

Construction of the Mediation Mechanism in the Settlement of Social Disputes——A Case Study of Chuxiong

伴随着经济社会的转型,我国社会矛盾纠纷不断加剧、日趋复杂,使得现行的以诉讼制度为核心的社会矛盾纠纷解决方式因成本过高、效率低下、受案范围窄而面临前所未有的困境。采用何种纠纷解决机制化解社会矛盾已成为全国性课题,云南省楚雄市通过构建大调解机制对此进行了有益的尝试。笔者分析了大调解机制的产生背景、特点、优势及运行过程中存在的不足,从思想、制度和技术三个层面提出了进一步完善大调解机制的对策。

With rapid development, social disputes occur in all walks of life. Current judicial system, which acts as the main source in settling social disputes is confronted with more difficulties. Finding new ways of mediation is a new effort in Chuxiong municipality. This research presents the background, features, advantages and disadvantages of the present mediation mechanism as well as suggestions for further improvement.
