中国网络法律体系的现状分析和未来建构——以2012年12月31日为截止时间点的分析

Present Situation and Future Construction of China’s Cyber Law System

网络法律是信息时代诞生的全新法律体系,信息时代的经济因素和社会因素共同决定了网络法律体系的建构将是中国法治完善发展的关键部分。本文以我国目前172个网络法相关规范为样本进行统计和分析,还原当前中国网络法律体系的整体特征和内在结构特征,指出了由于网络的代际差异和自身的立法结构缺陷,目前我国网络法律体系存在着较大的不足,而强化网络法基础理论研究和做好顶层设计有序推动网络法律体系建构,应当是中国未来网络法理论和体系建构的努力方向。

Cyber law is a new legal system born out of information era.Both the economical and social factors of this era de termine that the construction of Cyber law system will be a central part of the development of China ’s legal system.This thesis will take China’s current 172 specifications related to cyber law as a sample,restoring overall features and intrinsic structural features,at the same time,pointing out the shortcomings of cyber law system due to the generational differences of network and the defections of legislative structure.Strengthening the study of basic theory of cyber law,making top design of it,coupled with orderly promoting the construction of cyber law system will,as far as I ’m aware,be the future development of China’s cyber law theory and system.
