Problems and Countermeasures of Water Administration Law Enforcement in the Upper and Middle Reaches of the Yellow River Basin

黄河上中游流域水行政执法工作中存在法律制度不完善,基层水政机构无执法主体资格、权责不清晰,流域水行政执法权威性不够,与地方水行政主管部门的执法事权划分不明晰等问题。要解决这些问题,必须加快流域立法,完善流域水事法制体系;授予基层水政机构执法主体资格,切实履行水行政执法职责;明确流域与行政区域执法事权的划分,推进流域管理与区域管理的有机结合;大力开展水事法律法规宣传教育,增强全社会水事法制意识和法制观念。

The Problems in the water administration law enforcement work in the existing legal system in the upper and middle reaches of the Yellow River basin are not perfect;local administrative offices have no qualifications and hardly distinguish their rights and responsibilities;water administration law enforcement authority of the basin is insufficient,and the division of law enforcement authority between basin and local administrative departments of water is not clear and etc..In order to improve this situation,river basin legislation must be accelerated and perfected the legal system of the river basin;the qualification of administrative rights should be authorized to make laws well carried out;the division of law enforcement powers for river basin and local administration should be clarified;the cooperation between them should also be enhanced;Propaganda and education of water laws and regulations should be strengthened to enforce the public legal consciousness and the concept of legal system.
