摘要
分析EPC模式在中国现行法律框架下适用所遇到的工程总承包资质核准的缺乏、建筑工程监理制度、禁止违法分包制度、强制公开招标制度等障碍和问题,并提出相应的认识,以期启发思考和探索创新中国特色的EPC模式。
The impediments and problems concerning the application of EPC pattern under the current legal frame- work in China are analyzed, including the lack of qualification approval for overall contracting of projects, the sys- tem of construction projects supervision, the system of prohibited illegal subcontracting and the system of compulso- ry public bidding. Corresponding countermeasures are also suggested in this paper to inspire consideration and ex- plore innovation on EPC pattern with Chinese characteristics.
