摘要
随着拉萨市住房制度改革的深化,商品房市场的逐步完善,与之相适应的传统福利性房屋管理模式已被现代化的物业服务所代替。物业服务作为一种全新的模式,在延长物业的使用寿命,使其保值增值的同时也引发了物业服务费纠纷、物业接撤管纠纷以及第三方责任引起的纠纷等。对此,应当进一步完善立法,健全法制,促进物业服务合同有法可依;完善物业服务合同,使物业服务合同规范化;强化政府职能,促进拉萨市物业服务市场健康发展。
With the deepening of the housing system reform in Lhasa and gradual improvement of com- mercial residential building market,the traditional welfare housing management model has been replaced by the modern property service. The property service as a brand-new model is able to prolong the life of the house and to preserve and increase the value of the property. Meanwhile,the property service may cause dispute of property service fees,dispute on the takeover of property and termination of service,and dispute raised by the liabilities of the third party. Under the investigation and analysis on the origin of disputes,this article comes up with the strategies,including the improvement of legislation,construction of legal framework,promoting the legislation on the area of property service contract,and improving property service contract in order to make the property service contract more standardized. At the same time,it shall strengthen the function of government and promote the development of property service contract in Lhasa.
