摘要
互联网经济与传统经济相比,具有很多特殊性,这些特殊性对反垄断法的实施带来了严峻的挑战。在市场竞争领域,相关市场的界定通常是对竞争行为进行分析的前提。本文在360诉腾讯QQ案的基础上分析,认为网络反垄断中即时通讯产品及服务构成一个独立的相关商品市场,相关地域市场为中国市场。
When compared to the traditional economy,The Internet economy has many special properties,the implementation of the special nature of the anti-monopoly law has brought severe challenges.In the field of market competition,the definition of the relevant market is usually a prerequisite to analyze the competitive behavior.This paper analysis based on 360 v.Tencent case,think network antitrust in instant messaging products and services constitute an independent relevant commodity market,the relevant geographic market for the Chinese market.
