利益平衡视角下植物新品种权保护制度的完善

Improvement of Right Protection System of New Varieties of Plant in Perspective of Balance of Interest

利益平衡是知识产权法的根基。植物新品种权制度在赋予育种者以知识产权,调动育种者培育及研制植物新品种的积极性,激发其创造力的同时,应当兼顾社会公共利益,并尽力使育种者的权利与社会公共利益保持适当的平衡。为此,应对植物新品种权的权利对象、权利内容及权利限制各方面进行适度调整,创建适合我国需要的植物新品种权保护制度。

Balance of interest is the base of intellectual property law. The right system of new varieties ol plant gives breeders intellectual property, mobilizes breeders enthusiasm and creativity, at the same time, this system should take into consideration of public interest, and balance breeders right and social public interest. So, rights object, rights content and limitation of rights of new varieties of plant must be reasonably adjusted, and the right system of new varieties of plant must be built to satisfy the need of the country.
