论跨国犯罪的死刑适用问题

On the Application of Death Penalty to Transnational Crimes

我国目前对跨国犯罪的死刑适用问题研究不是很充分,但该问题在当前跨国犯罪屡见不鲜且日益严重的情况下显得非常突出。尽管跨国犯罪因跨国因素的复杂性而有多种表现,但在死刑适用上必须遵守刑法第48条第1款的规定。而且,宽严相济刑事政策对"少杀、慎杀"死刑政策有着积极的促进意义,凸现了其中所蕴含的限制死刑的法治目标,因而也应当贯彻于跨国犯罪案件的死刑适用过程中。据此,需要对跨国犯罪的国际影响区别对待,将国际正面影响作为对跨国犯罪适用死刑的酌定从宽情节予以考量,但不宜将国际负面或者恶劣影响作为死刑适用的考虑依据。

The present researches on the application of death penalty to transnational crimes are not very sufficient, as problems always occur and have become more serious than ever before. Transnational crime, for its complexity of transna- tional factors, has different forms. It is therefore necessary to comply with the provisions of the first paragraph of article forty-eighth of the criminal law. Moreover, the criminal policy of combining punishment with leniency plays an important role in implementing the death penalty policy of ＂less killing, killing carefully＂, which shows the legal targets of restricting death penalty, and should therefore be implemented. Accordingly, it is necessary to treat the international influences of transnational crimes discriminatively, and to take into account the international positive influences as discretionary lenient plots, but not the international negative or baneful influences.
