SWOT分析视域下的边境刑事案件侦破研究——以湄公河“10·5”案件为例

A Research on the Border Crime Detection in a SWOT Analysis Perspective--Taking the Mekong River ＂10 · 5＂ Case for Example

对边境刑事案件进行准确的分析和认识，才能真正做到依法惩治犯罪和保障公民权利。从湄公河“10·5”案这一实际案例入手，探讨了SWOT分析方法在边境刑事案件侦破过程中的重要作用，同时指出了SWOT分析方法应用在边境刑事案件侦破中的不足与解决方法。SWOT分析方法在边境刑事案件侦破过程中的合理运用，将对我国打击各种跨国刑事犯罪、保障人权起到较大的帮助作用。

By correctly analyzing and understanding the nature of the border crime case, the crime is to be punished and the rights of the citizens be protected. This paper investigates the Mekong River ＂10 · 5＂ case, in order to show the important function of SWOT analysis in the detecting process of border crime cases, and furthermore, to point out the drawbacks of the SWOT analysis in such cases and give some proper suggestions. Using the SWOT analysis in the border crime properly undoubtedly play an important role in combating transnational crime and protecting the human rights.
