我国刑法中的特殊法与一般法的立法完善

在我国刑法犯罪竞合关系中,特殊法具有一般法不可代替的独立价值。包容竞合关系中的"特殊法优于一般法",实质上是特殊情况下的"重法优于轻法"。但在我国刑法具有包容竞合关系的某些条文的具体规定中,适用"特殊法优于一般法"的原则,并没有体现出"重法优于轻法",这是刑法某些条文缺陷所致,应予修正。

The particular law taking priority over the ordinary law is equal to the severe law over the gentle law among the inclusive coincidence in some special circumstances. However the principle of the particular law taking priority over the ordinary law does not reflect the rule of the severe law over the gentle law in the specific stipula- tions of some provisions owning inclusive coincidence, which the flaws in the criminal law leads to and should be a- mended.
