摘要
2012年3月14日,第十一届全国人民代表大会五次会议通过了《全国人民代表大会关于修改〈中华人民共和国刑事诉讼法〉的决定》。律师介入提前、犯罪嫌疑人的变相"沉默权"等规定对职务犯罪侦查工作提出了更高的要求。监视居住制度是刑诉法修改的一大亮点,探讨如何灵活应用刑事诉讼法修改之后的监视居住强制措施,能为职务犯罪侦查提供新的手段和思路。
In March 14, 2012, the eleventh meeting of the five session of the National People＇s Congress pas- sed the ＂decision of the National People＇s Congress on the revision of criminal procedure law of the people＇s Re- public of China＂. Provisions of lawyers involved in advance, the suspect in the ＂right of silence＂ work put forward higher request to the duty crime investigation. Residential surveillance system is a major bright spot to modify the criminal procedure law, discusses how to flexibly use the amendment of criminal procedure law after the supervision of residence, also can provide new methods and thoughts for the duty crime investigation.
