借力从严从重打击环境污染犯罪——两高院《关于办理环境污染刑事案件适用法律若干问题的解释》的思考

To Strictly Crack down on Environment Pollution Crime by Convicting and Sentencing Criteria on Environmental Pollution Crime

2013年6月19日最高人民法院和最高人民检察院发布《关于办理环境污染刑事案件适用法律若干问题的解释》,并于当天正式施行,以期为我国环境保护司法实践提供技术支撑,为从严治理环境污染,严厉打击环境污染犯罪提供了必要的法理依据。本文在分析《解释》立法目的和要点及内容基础上,提出相应的建议以积极应对《解释》对环境执法工作提出的新要求。

The Supreme Peoples Court and The Supreme Peoples Procuratorateof P. R. C. issued＂ about the interpretation on some issues of applicable law to deal with the environment pollution criminal case＂ on June 19, 2013, so as to provide technical support for environmental protection in our country judicial practice, to strictly control environmental pollution and crack down the environmental pollution crime to provides the necessary legal basis. This paper puts forward corresponding suggestions in order to actively respond to environmental law enforcement new requirements by the law interpretation based on the analysis of the legislative purpose and key points and contents.
