离岸人民币资产证券化是跨境融资市场上兼具离岸融资业务与资产证券化创新双重特点的新产品。随着人民币国际化进程加速,离岸人民币市场迅速发展与成熟,在离岸市场开展跨境人民币资产证券化意义重大且具体可行。但离岸人民币资产证券化面临实体法、冲突法、程序法等一系列法律障碍,需要在不同层面完善相关法律法规体系,从而将离岸人民币资产证券化的设想转化为现实。

Offshore RMB asset securitization is the new product combining characteristic of offshore finance and innovation of asset securitization. With the rapid development of RMB internationalization and offshore RMB market, it is not only important but also possible to launch cross border RMB asset securitization in offshore RMB market. But the process will confront obstacles of substantive law, conflict law and procedure law in different levels. Proposition to revised and optimize the relative legal framework will be discussed for the purpose to make the securitization suggestion into reality.
