摘要
优先保护婚姻家庭住房权,具有重要的功能和价值,在我国不仅具有法理基础,而且具有现实的社会基础。从域外立法例看,一些国家已经有对婚姻家庭住房权有优先保护的立法内容。基于我国现实国情,宜借鉴他国立法经验,建立婚姻家庭住房权优先保护制度,以彰显我国宪法尊重和保护人权的基本理念,实现法律对婚姻家庭当事人基本人权的保障。
The preferential protection of marriage and family housing rights which boasts of a lot of functions and values has philosophical basis and profound social basis. However, some foreign countries have laws to protect the housing rights. Based on the national conditions, China shall establish the preferential protection system of marriage and family housing rights to protect the human rights.
