摘要
在西方法哲学传统中,自然法主要是指道德自然法,即人类生活中的正义与道德准则。从古希腊的自然法思想,到当代西方各种正义理论,自然法学形成了一整套思想价值体系,它先是与自然理性相同,继而与神的理性相连,最后与人类理性和实践理性相合。尽管自然法的内涵一直在变化之中,其共通之处在于,各种学说都反映了正义与秩序的结合,体现了人类运用法律创设正义社会秩序的不懈追求。
In the western tradition of legal philosophy, natural law mainly refers to the natural moral law, namely justice and ethics in human life. From natural law thought of ancient Greek, to a variety of contemporary western theory of justice, it has formed an ideological value system of natural law. Firstly, it has been same with natural reason. Then it was connected with God’s rational. Finally, it combined with the human reason and practical reason. Despite the connotation of natural law has been changing, its common is that all kinds of theories have reflected a combination of justice and order, reflecting the relentless pursuit of justice created by the law.
