论德国及我国台湾地区社会法的基本范畴

On the Basic Categories of Social Law in Germany and Taiwan District of China

在德国,社会法主要是指与社会安全有关的法律规范或者社会给付的法律规范。至于社会法的概念、范畴在德国已成为学术界、司法实务界、政治与社会共同认可的概念与术语。我国台湾地区的社会法理论也借鉴德国社会法的理论架构台湾地区的社会法制度,并使之成为一个逻辑自洽的体系。德国及我国台湾地区的社会法理论对大陆地区目前庞杂的社会法理论具有重要的启发价值。

In Germany, the social law maily refers to the law concerning social security or social welfare. As for the conceptual category of social law, in Germany it has become a common recognized concept or term in academia, judicial practice, political circles, and social sectors. The social law theory in China＇s Taiwan region uses the German social law theory for reference to structure its own social law system, and makes it a logically self-consistent system. The theory of social law in Germany and China＇s Taiwan region has important reference value to the current complex social law theory in China＇s mainland.
