摘要
通过对中国地理标志的梳理,分析了中国商标法保护地理标志的特点。比较近年来发生在国内外的香槟地理标志诉讼案件,并通过对诉讼结果及产生影响的分析,得出处理结果差异的原因,指出中国在地理标志保护问题上权利义务平衡问题,要在地理标志保护中尊重国际规则并获得自身利益最大化。
Based on the analysis of geographical indications in China, the characteristics of Chinese Trademark Law Protection were illustrated. Through the comparison of Champagne geographical indications lawsuits at home and abroad in recent years and the analysis of lawsuits results and their influence, the reasons inducing different lawsuits results were elaborated. It was pointed out that there were some problems in equilibri- um between rights and obligations in China in geographic indications protection. China should respect international rules in geographic indications protection to realize its individual interests maximization.
