台湾释宪实务制度下的大学自治

大学为追求高深学问之所,学术自由和大学自治为其制度性保障之一。然而基于法治国原则,大学仍在一定范围内受到国家的监督。在台湾释宪实务下,司法的介入对大学的影响很大,大学根据大法官解释在学生权利救济、在学关系及学校管理等方面都有相应改变。大学不再是特别权利关系下的"国中国"。台湾地区的大学既继承了民国以来的大学自治传统,又在民主政策下得到更为充分的发展,其经验值得中国大陆高校借鉴。

The university in Taiwan inherits university autonomy since the Republic of China, in the democratic policy university autonomy also have a full development we can learn many things from them.
