对我国知识产权法引入惩罚性赔偿的质疑

Questioning the Punitive Damages Introduced into Intellectual Property law in China

惩罚性赔偿的实质在于权利人所获得的赔偿金大于其损失,该原则只能作为补偿性原则的例外和补充而存在。我国现行法律针对知识产权侵权损害赔偿责任所确立的全面赔偿原则不仅符合民事法律的基本原理,而且也符合TRIPS协议所规定的保护标准。我国没有义务,也没有必要将惩罚性赔偿引入到知识产权法中。

The essence of the punitive damages is that the damages the right owners received or obtained is larger than their loss, which can only exist as an exception and supplementary to the principle of compensation. The principle of full compensation which is established by damages of intellectual property infringement of existing laws of our country is not only consistent with the basic princi- ples of civil law, but also meets the standards of protection under the TRIPS Agreement. There is no obligation and necessity to intro- duce punitive damages into intellectual property law in China.
