公正司法,是构建和谐社会的重要途径之一。鉴定结论作为法定证据之一,曾被誉为"证据之王"。近年来,随着法治社会建设进程的不断加快和司法鉴定机构蓬勃发展,因鉴定结论而引发的诸多问题日渐凸显。本文以西宁市为例,旨在探讨伤情司法鉴定在刑事诉讼活动中存在的因鉴定结论多样致使无法采信或采信错误等问题,剖析原因并提出相应对策建议。

In recent years, with the accelerating of the process of the construction of rule of law society and judicial authentication institu- tions vigorous development, cause identification conclusion caused a lot of problems highlighted. This pa- per takes Xining city as an example, aims to explore the state judicial identification in criminal proceedings because of the appraisal conclusion diversity makes it impossible to admission or accepted error problems, analyze the reasons and put forward corresponding countermeasures and suggestions.
