摘要
对《侵权责任法》实施后我国医疗损害赔偿司法实践中遇到的问题进行了调研,并进行归纳和总结,结合国外相关制度,提出契合我国当前实际的、兼具科学性和可行性的建议,以期为最高人民法院制定相关司法解释和相关部门制定政策提供依据。
Problems about medical damage liability in legal practice had been found and summarized after implementing Tort Liability Law.Learning from relative laws in foreign counties,suggestions which matches Chinese situation and has feasibility are presented to give evidence for supreme people＇s court making judicial interpretation and relative department making policy.
